1. Acceptance of Terms

By accessing or using Peeke's session recording and analytics services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

If you do not agree to these Terms, you may not access or use the Services.

2. Description of Services

Peeke provides session recording, user analytics, and event tracking services that allow you to understand how users interact with your website or application. Our Services include:

  • Session replay and recording
  • User behavior analytics
  • Event tracking and custom events
  • User identification and profiles
  • Dashboard and reporting tools

3. Account Registration

To use our Services, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly update your account information if it changes
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access

4. Acceptable Use

You agree to use the Services only for lawful purposes and in accordance with these Terms. You shall not:

  • Use the Services to collect data without proper user consent
  • Record sensitive information such as passwords, credit card numbers, or personal health information
  • Violate any applicable laws or regulations, including GDPR, CCPA, or other privacy laws
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Use the Services to develop a competing product
  • Reverse engineer, decompile, or disassemble any part of the Services
  • Resell or redistribute the Services without authorization
  • Transmit malware, viruses, or other harmful code

5. Your Responsibilities

As a user of our session recording services, you are responsible for:

  • User Consent: Obtaining all necessary consents from your end users before recording their sessions, in compliance with applicable privacy laws
  • Privacy Policy: Maintaining an accurate privacy policy on your website that discloses your use of session recording and analytics tools
  • Data Protection: Implementing appropriate data protection measures and complying with GDPR, CCPA, and other applicable regulations
  • Sensitive Data: Configuring the Services to mask or exclude sensitive personal data from recordings
  • Cookie Consent: Implementing appropriate cookie consent mechanisms where required by law

6. Data Processing

When you use our Services, we process data on your behalf as a data processor. You remain the data controller for all end-user data collected through our Services. Our processing activities are governed by our Privacy Policy and any applicable Data Processing Agreement.

We implement appropriate technical and organizational measures to ensure the security of your data, including encryption in transit and at rest.

7. Intellectual Property

Our Rights: Peeke and its licensors retain all rights, title, and interest in the Services, including all intellectual property rights. These Terms do not grant you any rights to use our trademarks, logos, or brand features.

Your Rights: You retain all rights to your data and content. By using our Services, you grant us a limited license to process your data solely to provide the Services.

8. Service Availability

We strive to maintain high availability of our Services. However, we do not guarantee uninterrupted access and may occasionally need to perform maintenance or updates. We will provide reasonable notice of planned downtime when possible.

9. Pricing and Payment

Peeke currently offers a free tier of service. If we introduce paid plans in the future:

  • Fees will be communicated clearly before you are charged
  • You will be notified of any pricing changes at least 30 days in advance
  • Payments are non-refundable unless otherwise stated

10. Termination

Either party may terminate this agreement at any time. Upon termination:

  • Your access to the Services will be revoked
  • We will delete your data within 60 days, unless legally required to retain it
  • You may request a data export before termination

We may suspend or terminate your access immediately if you violate these Terms or engage in conduct that we determine, in our sole discretion, is harmful to us or other users.

11. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, or completely secure.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PEEKE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

Our total liability for any claims under these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Peeke, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Services, your violation of these Terms, or your violation of any third-party rights.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Services after such changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Sweden.
